Accident at work – Cold Injury Compensation (millitary service)

About Cold Injuries and Military Personnel

All employers have a responsibility to protect their employees from injuries at work . This includes protection from cold injury.

If you have been diagnosed with a cold injury (whether a member of the Armed Forces or not) then you may be entitled to compensation.

Service Personnel will often have to operate in freezing and wet conditions for prolonged periods of time when the risk of cold injury becomes real. The MoD, through the chain of command, is obliged to assess the weather conditions and provide suitable personal protective equipment including boots, socks and gloves and they are also obliged to carry out regular foot inspections for signs of injury developing.

Unfortunately, all too frequently this does not happen.

Whilst anyone can suffer such an injury, it has been well known since the Second World War 1944-1945 that African-Caribbean soldiers are more susceptible to cold injuries than personnel of other ethnicities. Thompsons Solicitors have significant experience of representing clients who have been diagnosed with cold injuries securing substantial amounts of compensation on their behalf.

If you have been diagnosed as suffering from a cold injury due to your working conditions, you may be able to make a personal injury claim for compensation.

To find out if we can help you, call us on 08000 224 224 or complete one of our online personal injury compensation claim forms.

Different types of Cold Injury

Non Freezing Cold Injury (Trench Foot), Hypothermia and Freezing Cold Injury (Frost Nip and Frost Bite)

There are different types of cold injury, the most common being Non Freezing Cold Injury (formerly known as “Trench Foot”). Other types of cold injury include Hypothermia and Freezing Cold Injury (Frost Nip and Frost Bite).

Personnel diagnosed with cold injuries often suffer life changing consequences and permanent disability. Cold injuries can be debilitating causing numbness, tissue damage, loss of digits and long term pain and permanent intolerance to cold conditions.

Diagnosis and treatment of cold injuries (particularly Non-Freezing Cold Injury) is often difficult. Following diagnosis it may also lead to discharge from military service, which then results in often signficiant financial loss being incurred.

If your working conditions have caused you to develop a cold injury, you may be entitled to make a personal injury compensation claim.  To discuss the options available to you with no obligation, call us on 08000 224 224 or complete one of our online personal injury compensation claim forms.
